Application for Second Dwelling on a Lot
This provision is only available to a property owner(s) whom has been issued a permit to construct a new single-family dwelling but would like to continue to reside in an existing dwelling on the same property until occupancy has been reached. By entering into this Agreement, the owner(s) acknowledges that the existing dwelling must be demolished or removed from the property within one (1) year from the date the permit was issued for the new dwelling.
In addition to completing this application, the owner(s) must provide a quote from a qualified contractor outlining the cost of demolishing the existing dwelling (including landfill fees), and a deposit, in the form of a cheque in the total amount quoted, in order to ensure the requirements of the Agreement are completed within the prescribed timeframes.
Once the year deadline has reached, the new dwelling has achieved occupancy and the existing dwelling has been demolished (including site clean-up), the owner(s) may request the refund of the deposit in the amount of the contractor's quote, without interest, as the terms of the Agreement have been satisfied in a timely manner. If the Agreement is not satisfied, the Agreement provides the Municipality access to enter the land and the authority to use the deposit to complete the necessary demolition of the existing dwelling, as a final measure.
