Application for No Demand for Services Site Plan Agreement

The Agreement is required where a property is accessed by way of a road or road allowance that is not maintained by the Municipality, this includes private and seasonal roads. Through this Agreement, the property owner(s) acknowledge that the Municipality does not provide all or any services to said road. Further, the owner covenants and agrees that no demand will be made to the Municipality and/or County for the provision of year-round access to the subject land and that obtaining access will be the sole responsibility of the property owner(s). Services entailed are fire protection (if the state of the private or unmaintained road do not permit safe entry), drainage works, road maintenance, snow clearance, waste management, etc.

The No Demand for Services Site Plan Agreement is typically prompted through future development of the property, requiring a building permit. At times, properties requiring same will have a zoning designation of 'lms' (limited municipal services) and/or the property may have a holding zone provision, that must be lifted once this process is completed. There is a section within this application that addresses properties with holding zone provisions. 

The fee associated with this process is seven-hundred and fifty-dollars ($750.00). This fee includes/covers the costs to register the information on title by our solicitor.
